    1.1 Scope of Service
    Aithor.io is a digital platform developed and managed by Digitup Studio S.L. whose main objective is to make available to individual users, especially students, advanced tools based on artificial intelligence (AI) for the generation, editing and analysis of academic or professional content.

    The Platform allows the User to access, by subscription or free limited use, functionalities such as: assisted document creation, text analysis and rewriting, resume generation, content extraction from links or files, and other tools aimed at improving productivity and the quality of intellectual work, without incurring high costs or requiring advanced technical knowledge.

    1.2 Subject Matter of the Contract

    The purpose of this agreement is to regulate the conditions of access and use of the Aithor.io platform (hereinafter, the “Platform”) and all the services, contents and functionalities that it makes available to the user (hereinafter, the “User”), either free of charge or by subscription.

    By registering and using the Platform, the User declares to have read, understood and fully accepted these Terms and Conditions, being legally bound by them.

    The functionalities offered include, among others: content creation through artificial intelligence models, interaction with virtual assistants, link analysis, extraction of information from PDF files, document elaboration and access to specialized tools. The User undertakes to make a responsible and ethical use, in accordance with the applicable legislation, as well as to respect the rules of use established by Aithor.

    1.3 Modifications to the Terms

    Digitup Studio S.L. reserves the right to modify, update or delete, at any time and at its sole discretion, all or part of these Terms and Conditions, as well as the features, functionality or services offered on the Platform.

    Changes of a minor or merely informative nature – those that do not significantly affect the rights or obligations of the User – may be notified by publication on the Platform itself or by e-mail sent to the address provided at registration.

    In the event that the changes are substantial, especially if they affect the processing of personal data, the form of service provision or economic conditions, the User will be asked for their express acceptance through the means provided for this purpose. Until such acceptance is received, the User may choose to stop using the service without penalty.

    The continued use of the Platform after the reasonable notification period has elapsed, or the express acceptance when required, will imply the User’s agreement with the new terms.

    2. Registration and Use

    2.1 Use of the Platform

    Aithor.io is a digital platform that allows registered users to access artificial intelligence (AI)-based tools to generate, edit, analyze and organize textual and multimedia content for educational, academic or professional purposes.

    Available functionalities include, but are not limited to:

    • Interaction with AI models for generating written content, analyzing information and writing customized documents.
    • Tools for text extraction from PDF files or public links.
    • Creation of resumes, essays, and other types of academic or work-related content.
    • Conversation bookmarking and management: bookmarking, copying, exporting or sharing chats with third parties.

    The User agrees to use the Platform ethically, lawfully and in accordance with the purpose for which it was designed. Under no circumstances may use the services of Aithor for the commission of illegal, fraudulent, contrary to morality, public order, or to infringe the rights of third parties.

    Digitup Studio S.L. reserves the right to limit, suspend or cancel the access to the Platform if it detects a misuse, abusive or contrary to these Terms and Conditions.

    2.2 User Registration

    To access the services of the Platform, the User must first register by creating a personal account using the form provided for this purpose.     2.3 License of Use

    By registering with Aithor, the User acquires a limited, revocable, non-exclusive, non-transferable and non-sublicensable license to access and use the Platform and its services, solely and exclusively in accordance with these Terms and for the intended purposes: educational, academic, personal or lawful professional.

    This license does not imply in any case a transfer of intellectual property rights over the Platform or its functionalities, algorithms, AI models or generated content.

    It is expressly prohibited:

    • Reproduce, copy, distribute or commercially exploit the services or content generated, unless expressly authorized by Digitup Studio S.L.
    • Automate access through bots, scripts, scraping systems, data mining or other automated information extraction techniques.
    • Use the Platform for the purpose of developing a similar or competitive product or service.
    • Share access with third parties or resell the service, either directly or indirectly.

    Any unauthorized use shall constitute a breach of contract and may result in immediate suspension of the User’s account, as well as appropriate legal action.

    2.4 User Responsibility
    The User is solely responsible for its use of the Platform and agrees to:

    • Keep your login credentials (email and password) confidential and do not share them with third parties.

    • Ensure that all information provided to Aithor is truthful, accurate, up-to-date, and complete at all times.

    • Use the Platform and its tools ethically, diligently, and in accordance with applicable laws and these Terms.

    The User declares and guarantees that they hold all necessary rights, licenses, and permissions for the content they input or generate through Aithor, and agrees to hold Digitup Studio S.L. harmless from any claims, damages, or liabilities arising from the misuse of the Platform or the content shared.

    3. AI Virtual Assistants

    3.1 Interaction with Artificial Intelligence

    Through Aithor, Users can interact with artificial intelligence (AI) systems to generate personalized content tailored to their educational, personal or professional needs. This interaction can be done directly from the Platform or through external integrations, such as web applications, Telegram, WhatsApp or other compatible interfaces.

    Functionalities include, among others:

    • The creation of customized instructions or “prompts” to generate text, summarize information, perform analysis or build documents.
    • The use of data extraction and processing tools from public links or PDF documents.
    • The ability to adjust certain parameters to adapt the AI output to the context or style desired by the User.

    The User acknowledges and accepts that the content generated by the AI is the result of automated and statistical processes, and therefore may contain errors, inaccuracies or incorrect statements. Aithor does not guarantee the truthfulness, completeness or suitability of the content generated for a specific purpose.

    Likewise, the User is solely responsible for the use made of such content, including its dissemination, edition or incorporation in academic or professional works.

    In the case of using Aithor through third party platforms, the User also accepts the terms of service and privacy policies applicable to such platforms.

    3.2 Use of Artificial Intelligence Technologies

    Aithor integrates advanced artificial intelligence technologies developed by third parties, including – but not limited to – language models from OpenAI (GPT-3.5 Turbo, GPT-4, GPT-4 Turbo), Google (Gemini), Anthropic (Claude), Mistral, DeepSeek, and other vendors that may be incorporated in the future based on their performance, security and availability.

    These models have been trained on large volumes of data and allow the generation of contextualized, relevant and personalized textual content, based on the instructions entered by the User.

    The User acknowledges and agrees that:

    • The answers generated by these systems are the product of probabilistic algorithmic processes, so they may contain errors, omissions or unverified information.
    • Aithor does not guarantee the truthfulness, accuracy, timeliness or suitability of the content generated, especially in sensitive areas such as legal, medical, academic, financial or personal.
    • Digitup Studio S.L. acts exclusively as an integrator and facilitator of such technologies, without intervening in the internal logic or the source of the data used by the AI models.

    The User is responsible for verifying the content prior to its use, publication or dissemination, and agrees not to use it as a substitute for professional advice, nor to present it as original content in contexts where it violates ethical, contractual or academic standards.

    3.3 Testing and Initial Evaluation Phase
    When starting their experience with Aithor, the User will be able to access an initial free or promotional trial phase -when available- that will allow them to explore the Platform’s functionalities, adjust preferences, and assess the usefulness of the artificial intelligence tools before opting for an active subscription or a more intensive use.

    During this phase, the User will be able to:

    • Test different functions and evaluate the quality of the responses generated by the AI.
    • Adjust parameters according to his preferences or specific needs.
    • Determine if the functionalities offered are adequate to their objectives.

    The existence or duration of this test phase will be determined by Aithor at its discretion, and may vary depending on active promotions, User profile, country of residence or usage history.

    Content generated during the trial phase is also subject to these Terms and Conditions, including restrictions on use, intellectual property and liability.

    4. Subscriptions, Billing and Cancellation

    4.1 Subscription Plans
    Aithor offers access to its premium functionalities on a subscription basis, in three automatically renewable plans: monthly, quarterly and annual. All plans include the same advanced artificial intelligence functionalities.

    The prices in effect during the launch promotion are as follows:

    • Monthly Plan: 14.99 € per month (no discount).
    • Quarterly Plan: €9.99 per month, billed at €29.97 every three months (35% discount).

    All plans include:

    4.2 Billing and Payment Methods

    Subscriptions to Aithor’s plans are billed automatically at the beginning of each cycle (monthly, quarterly or annually, depending on the plan chosen), and collection is done through secure third-party payment providers.

    Aithor accepts the following payment methods:

    ● Credit and debit cards (Visa, Mastercard, American Express, Discover), via Stripe gateway.
    ● Payments via PayPal account.

    The charge will be made in the relevant local currency, where possible, and amounts may be subject to currency conversions or bank fees depending on the User’s country of residence or the payment method used.     4.3 Cancellation of Subscription

    The User may cancel his subscription to the premium plan at any time, without having to justify his decision, through the subscriptions section available in his account within the Platform.

    The cancellation implies that the next billing cycle will not be renewed. The User will maintain access to premium features until the end of the period already paid, after which his account will automatically switch to free mode, if available.

    No refunds will be made for unused subscription periods once the billing cycle has started. Therefore, it is recommended to cancel the subscription well in advance of the renewal date to avoid unwanted charges.

    In the event that the User experiences technical difficulties that prevent him/her from canceling from his/her account, he/she may request cancellation in writing by sending an email to [email protected] indicating his/her name, email address associated with the account and the reason for the request.

    4.4 Returns

    Refund requests will be evaluated individually and resolved on a case-by-case basis at the sole discretion of Digitup Studio S.L., depending on the specific circumstances and the User’s usage history. To initiate a refund request, the User must contact the support team by writing to [email protected], including their full name, the email address associated with the account, proof of payment, and a detailed explanation of the reason for the request.

    Refunds may be considered in exceptional cases such as:

    • Duplicate charges.

    • Technical failures that prevented access to the service for a significant period.

    • Billing errors attributable to the Platform.

    Refunds will not be granted in the following cases:

    • Voluntary cancellation after using the service.

    • Dissatisfaction with AI-generated responses.

    • Breach of the Terms by the User.

    • Change of mind after purchasing the service.

    Submitting a refund request does not guarantee approval. If approved, the refund will be processed using the original payment method within a maximum of 15 business days from the date of the favorable resolution.

    4.5 Changes in Plans and Pricing

    Any change that financially affects the User will be communicated with reasonable notice through the email provided during registration or by notification on the Platform. Such changes shall only apply as of the next billing period, and never retroactively.

    The User shall have the right to cancel his subscription before the new prices or conditions come into effect. The lack of cancellation within the indicated term will be considered as tacit acceptance of the new terms.

    Digitup Studio S.L. will not be obliged to maintain promotional conditions, historical prices or commercial advantages beyond the period contracted at the time of purchase.

    5. Waivers and Warranties

    5.1 Disclaimer of Warranties and Limitation of Liability

    Aithor is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. without warranties of any kind, either expressed or implied. Although Digitup Studio S.L. strives to provide a functional, stable and secure platform, it does not guarantee that the service will be free of errors, interruptions, delays or technical failures, nor that the content generated will be adequate, complete, accurate or truthful.

    • The service is provided in good faith, with an ongoing commitment to reliability, but the total absence of errors, interruptions or loss of access due to technical, maintenance or external causes cannot be guaranteed.
    • Digitup Studio S.L. undertakes to protect the User’s data in accordance with the provisions of its Privacy Policy and in compliance with current legislation on data protection.

    The User agrees that, given the experimental and statistical nature of artificial intelligence technology, it is his responsibility to know the limitations inherent in its use and act with discretion before applying or disclosing any results generated by the Platform.

    6. Data Protection

    6.1 Use and Purpose of Data Processing

    By registering and using the Aithor Platform, the User authorizes Digitup Studio S.L. to collect and process certain personal data necessary to properly provide the service.

    The data collected includes, among others:

    Name or pseudonym.
    E-mail address.
    Technical information about the device and the use of the Platform (browser type, operating system, time zone, IP, activity logs, functions used, session duration, clicks and browsing behavior).

    The legal basis for this processing is the performance of the contract (art. 6.1.b of the GDPR), the legitimate interest in improving the service (art. 6.1.f), and the explicit consent of the User for commercial communications, where applicable (art. 6.1.a).

    7.3 Termination of Service

    Digitup Studio S.L. reserves the right to suspend or cancel, immediately and without notice, the access of a User to the Platform, as well as its active subscription, in case of breach of these Terms and Conditions, or when detected:

    • Infringement of third party rights or current regulations.
    • Behavior that negatively affects the operation, security or reputation of the Platform.

    Also, the User may request voluntary deletion of your account and personal data at any time, in accordance with the provisions of the Privacy Policy.

    Termination of access, for any reason, shall not entitle the User to reimbursement of payments already made, except as expressly provided in the refunds clause or when required by applicable law.

    7.4 Applicable Law and Jurisdiction

    8.1 General Description

    8.2 Integrated Suppliers

    External services used include:

    • Firebase (Google Cloud Platform): for hosting, authentication, databases and backend functions.
    • Stripe and PayPal: for payment management, billing and secure invoicing.
      OpenAI, Gemini, DeepSeek, Anthropic, Mistral, among others: for content generation using artificial intelligence models.
    • Mailgun: for sending transactional e-mails.
    • Google Analytics, Hotjar and similar: for measuring the use of the Platform and behavioral analysis.

    8.3 Limitation of Liability
    Digitup Studio S.L. will not be responsible for failures, interruptions, errors or security vulnerabilities attributable exclusively to the internal operation of these external services. However, it undertakes to use providers that offer reasonable technical and contractual guarantees in accordance with current regulations.

    8.4 Changes in Services
    Digitup Studio S.L. reserves the right to modify, add or replace at any time the external services used in the Platform, provided that the essential quality of the contracted service is maintained. In case of relevant changes that affect the User, it will be properly informed through the usual means.

    9. Intellectual Property Rights

    9.1 Ownership of the Service

    All content, structure, design, source code, functionalities, algorithms, databases, images, trademarks, trade names, logos, texts and any other element integrated in the Aithor Platform are the exclusive property of Digitup Studio S.L., or of third parties with whom it maintains valid license agreements.

    Such contents are protected by national and international legislation on intellectual and industrial property.

    9.2 Limited Use License

    Digitup Studio S.L. grants the User a non-exclusive, revocable, non-transferable license limited to the legitimate personal or professional use of the Platform, as provided in these Terms.

    In no case does this license grant rights of exploitation, reproduction, distribution, modification, public communication or reverse engineering on the software, interfaces or systems used in Aithor.

    9.3 Restrictions on Use

    The User agrees not to:

    • Copy, clone or reuse elements of the Platform to develop similar or competing products.
    • Reproduce or distribute content generated by Aithor massively, automatically or for unauthorized commercial purposes.
    • Use the Aithor brand or distinctive signs of Digitup Studio S.L. without express written consent.

    9.4 Generated Content

    Content generated by the User on the Platform through prompts or interactions with the AI may be used, stored and processed by Aithor to:

    • Provide the requested service.

    Digitup Studio S.L. does not claim ownership rights over the texts or results generated by the User, but reserves the right to review, block or remove content that infringes these Terms, the rights of third parties or applicable law.

    9.5 Violations
    In the event that any person or entity detects a possible infringement of intellectual property rights in relation to the content displayed or generated on Aithor, they may contact the legal team by writing to [email protected], providing sufficient evidence for evaluation.

    10. Refund Policy

    10.1 General Definition

    This policy establishes the terms under which the User may request the refund of amounts paid for subscriptions or services contracted on the Aithor.io Platform.

    10.2 Application and Eligibility Criteria

    Refund requests may be submitted within 30 calendar days from the date of purchase, provided that any of the following conditions are met:

    • Duplicate charges or billing errors attributable to Aithor.
    • Proven technical failures that have prevented access to or use of the service for a relevant period.
    • No significant use of the contracted service (under evaluation of the support team).

    10.3 Exclusions

    No refunds will be granted in the following cases:

    • Voluntary cancellations once the billing cycle has started.
    • Dissatisfaction with the content generated by the IA, when the service has been effectively provided.
    • Misuse, abusive or contrary to the Terms and Conditions.
    • Requests outside the established term.
    • Errors beyond Aithor’s control in the payment method or exchange rate.

    10.4 Procedure

    The User must request the refund in writing by sending an email to [email protected], including:

    Full name and email linked to the account.
    Order number or proof of payment.
    Detailed reason for the request.

    Digitup Studio S.L. will review each case individually and will notify the decision within 10 working days.

    10.5 Reimbursement Approved
    If the request is accepted, reimbursement will be made through the same original payment method within an estimated 10 to 15 business days, subject to the financial provider’s deadlines.

    10.6 Policy Changes
    Digitup Studio S.L. reserves the right to modify this policy at any time. Changes will be duly communicated and will not affect requests submitted prior to their entry into force.

    Conclusion and Acceptance of Terms

    By accessing and using the Aithor Platform, the User declares to have read, understood and accepted in its entirety the present Terms and Conditions, such use constituting an unequivocal manifestation of his legal consent.

    The present Terms and Conditions constitute a binding agreement between the User and Digitup Studio S.L., and regulate the use of all present and future services available on the Platform.

    The current version will always be accessible on Aithor’s official website and will prevail over any previous printed or digital version of the Conditions.
