Terms and Conditions

These Terms and Conditions govern access to and use of Aithor, its artificial intelligence–based tools, and associated services.

By creating an account, purchasing a subscription, acquiring credits, starting a paid trial, or expressly accepting these Terms, the User confirms that they have read them and agree to be bound by them.

1. Service provider

These Terms apply to:

  • aithor.io
  • Its subdomains and web applications.
  • Aithor mobile applications.
  • Extensions, integrations, and features associated with Aithor.

Hereinafter, all of these services will be referred to collectively as “Aithor” or “the Platform”.

2. What Aithor offers

Aithor provides digital tools based on artificial intelligence intended to help the User create, edit, research, analyze, transform, and organize content.

Among other features, Aithor may allow:

  • Generating, correcting, summarizing, rewriting, translating, or adapting texts.
  • Interacting with artificial intelligence assistants.
  • Creating outlines, documents, study materials, and presentations.
  • Analyzing files, PDF documents, images, audio, videos, or links.
  • Searching for and organizing sources, citations, and references.
  • Saving projects, conversations, files, and preferences.
  • Using different artificial intelligence models and providers.
  • Accessing new tools that are added later.

The specific availability of each feature may depend on the subscribed plan, available credits, country, language, device, application version, or the technical capacity of the service.

Aithor may modify, improve, replace, or withdraw features when necessary for technical, legal, commercial, or security reasons, or due to changes in third-party services.

When a modification materially affects a paid feature, the User will be informed with reasonable advance notice and the rights they are entitled to under applicable law will be respected.

3. User account

Some features require creating an account.

The User agrees to:

  • Provide accurate and up-to-date information.
  • Keep their credentials protected.
  • Not share their account with unauthorized persons.
  • Notify Aithor if they detect unauthorized access.
  • Use only the official access mechanisms.

Each account is personal. Creating multiple accounts to repeatedly obtain trials, credits, promotions, or benefits, or to circumvent limits, blocks, or payments, is not permitted.

The User is responsible for activities carried out from their account when these result from their actions or from a breach of their security obligations.

Aithor may request email verification or other reasonable authentication mechanisms.

To use Aithor, the User must have sufficient legal capacity to accept these Terms. Where applicable law requires parental authorization, a minor may only use the Platform with the involvement of their parent or legal guardian.

4. License of use

Chatbot App Limited grants the User a limited, personal, non-exclusive, non-transferable, and revocable license to use Aithor in accordance with these Terms.

This license allows use of the Platform for lawful academic, educational, personal, or professional purposes, within the limits of the subscribed plan.

The license does not transfer to the User ownership of the software, brand, interfaces, designs, databases, templates, documentation, or technology used by Aithor.

Except with express authorization or legal permission, the User may not:

  • Copy, resell, rent, or sublicense access to Aithor.
  • Share credentials with unauthorized third parties.
  • Reverse engineer or attempt to obtain the source code.
  • Extract data, responses, or content in an automated or mass manner.
  • Use unauthorized bots, scraping, or automated systems.
  • Circumvent payments, usage limits, or security measures.
  • Use Aithor to develop or train a substantially similar or competing service through systematic extraction of its results or features.
  • Use Aithor’s brands, logos, or domains without authorization.

5. Permitted use and prohibited conduct

The User must use Aithor lawfully, responsibly, and with respect for third-party rights.

It is not permitted to use the Platform to:

  • Carry out illegal, fraudulent, or deceptive activities.
  • Infringe copyright, privacy, data protection, image, honor, confidentiality, or industrial property rights.
  • Enter third-party information without authorization or a legitimate basis.
  • Impersonate another person.
  • Distribute malware, harmful code, or content intended to compromise systems.
  • Access accounts, data, models, or infrastructure without authorization.
  • Interfere with the security or availability of the Platform.
  • Circumvent limits, blocks, access controls, or payment systems.
  • Generate or distribute illegal content or content intended to cause harm.
  • Use the results to deliberately deceive third parties.
  • Breach applicable academic, professional, or institutional rules.
  • Present content as one’s own when the institution requires disclosure of artificial intelligence use.
  • Automate use of Aithor outside authorized interfaces or integrations.

Aithor may limit, suspend, or cancel an account when there are reasonable indications of fraud, abuse, unlawful activity, non-payment, security risk, or breach of these Terms.

Where possible, the User will be informed and allowed to remedy the breach. In serious or urgent situations, the measure may be applied without prior notice.

6. User content

The User retains the rights they hold over the texts, instructions, documents, files, images, audio, videos, and other materials they provide to Aithor.

By uploading content, the User grants Chatbot App Limited a limited, non-exclusive, and royalty-free license to host, copy, technically transform, transmit, and process it to the extent necessary to:

  • Provide the requested features.
  • Generate the results.
  • Save and synchronize projects.
  • Provide support.
  • Prevent fraud, abuse, or security incidents.
  • Comply with legal obligations.
  • Enforce these Terms.

This license does not allow Chatbot App Limited to sell the User’s content as a standalone product.

The User represents that they have the rights, authorizations, or legal bases needed to provide and process the content they enter into Aithor.

The User should avoid uploading confidential, secret, or specially sensitive information when it is not necessary to use the requested feature.

The processing of personal data is explained in more detail in the Aithor Privacy Policy.

7. Results generated by artificial intelligence

Aithor’s results are produced by automated and probabilistic systems.

Therefore, they may contain:

  • Errors or contradictions.
  • Incomplete or outdated information.
  • Non-existent references, citations, or sources.
  • Incorrect interpretations.
  • Biases.
  • Content similar to that generated for other users.
  • Text that does not fully follow the instructions provided.

Aithor does not guarantee that results are accurate, original, exclusive, free of third-party rights, or suitable for a specific purpose.

It also does not guarantee that content:

  • Will be accepted by a university, educational institution, employer, or platform.
  • Will comply with the academic rules of a particular institution.
  • Will pass artificial intelligence or plagiarism detection systems.
  • Will obtain a specific grade or outcome.
  • Can be registered or protected by copyright.

The User must review, correct, and verify the results before using, publishing, submitting, or sharing them.

The results do not constitute legal, medical, financial, tax, psychological, or specialized professional advice.

The User is responsible for the final use made of the results and for complying with the applicable rules of their institution, profession, or activity.

8. Rights in the results

Chatbot App Limited does not claim ownership of the results generated specifically for the User.

To the extent Chatbot App Limited may have any right in them, it grants the User a non-exclusive authorization to use, modify, reproduce, publish, distribute, or commercially exploit them.

This authorization does not grant rights over:

  • Third-party content included in the result.
  • Third-party trademarks, images, works, or protected materials.
  • Aithor’s internal technologies, models, or systems.
  • Elements over which Chatbot App Limited cannot grant rights.

Due to the nature of artificial intelligence, identical or similar results may be generated for other users.

The User must check that the result does not infringe third-party rights before using it.

9. Plans, credits, and limits

Aithor may offer:

  • Limited free access.
  • Recurring subscriptions.
  • Free or paid trials.
  • Credit purchases.
  • Promotions and discounts.
  • Individual or team plans.

Applicable prices, currencies, taxes, features, and limits will be shown before confirming the purchase.

Conditions may vary depending on the country, currency, device, purchase channel, or available promotion.

Credits:

  • Are personal and cannot be transferred.
  • May be subject to an expiration date disclosed before purchase.
  • Are consumed according to the type and cost of the feature used.
  • Have no monetary value outside Aithor.
  • Cannot be redeemed for money, unless applicable law requires it.

Aithor may establish reasonable limits to protect service stability, prevent abuse, and manage the cost of artificial intelligence models.

Expressions such as “unlimited” may be subject to a fair use policy intended to prevent automation, resale, abusive sharing, or extraordinary consumption that affects the Platform’s operation.

10. Subscriptions and automatic renewal

When a recurring subscription is purchased, it will renew automatically for equivalent periods until the User cancels renewal, unless expressly stated otherwise.

Before purchasing, the following will be shown:

  • The price.
  • The currency.
  • The period duration.
  • The billing frequency.
  • Applicable taxes.
  • Included features and limits.
  • Trial conditions, if any.
  • Whether automatic renewal will occur.

By confirming a subscription, the User authorizes the initial charge and the corresponding recurring charges until renewal is canceled.

A free or paid trial may automatically convert into a subscription when this condition and the subsequent price were shown before purchase.

Prices may change for future renewals. When a change affects an active subscription, Aithor will communicate it in advance. The User may cancel before the new price becomes applicable.

If a payment cannot be processed, Aithor or the payment provider may retry the charge, request another payment method, limit paid features, or cancel the subscription.

11. Cancellation

The User may cancel automatic renewal at any time.

Cancellation must be carried out through the same channel used to purchase the subscription:

  • From the account settings, when the purchase was made directly on Aithor.
  • From the Apple App Store, when purchased through Apple.
  • From Google Play, when purchased through Google.
  • From the corresponding external provider, when that provider manages the subscription.

Uninstalling an application, signing out, or deleting the account does not necessarily cancel a subscription.

After canceling:

  • The next recurring charge will not be made.
  • Paid access will normally continue until the end of the period already paid.
  • The account may then move to a free or limited mode.
  • Cancellation will not automatically delete the account or stored documents.

To avoid a new renewal, cancellation must be completed before the charge date indicated in the account or by the corresponding provider.

Canceling renewal does not automatically generate a refund for the period already started.

12. Refunds and withdrawal

Refund requests will be resolved according to:

  • Applicable law.
  • The conditions shown during purchase.
  • The channel used to make the payment.
  • The specific circumstances of the request.

A refund may be due, among other cases, when there is:

  • A duplicate charge.
  • An amount different from the one accepted.
  • A renewal made after a valid cancellation.
  • An unauthorized transaction, after the necessary checks.
  • A billing error attributable to Aithor.
  • A serious and continued technical failure that substantially prevents use of the contracted service.
  • A digital service that does not conform to what was contracted.
  • Another case in which a refund is legally mandatory.

As a general rule, a voluntary refund will not be granted solely because:

  • The User has not used the subscription.
  • They forgot to cancel renewal.
  • They no longer need the service.
  • They uninstalled the application.
  • They are not satisfied with a specific result generated by artificial intelligence.
  • They did not use the credits before a previously disclosed expiration.
  • They breached these Terms.

These exclusions do not limit the mandatory rights that apply to the User as a consumer.

When the purchase was charged directly by Chatbot App Limited, the request may be sent to [email protected] from the email associated with the account, stating the date, amount, currency, and transaction reference.

When the purchase was managed by Apple, Google, or another external platform, the refund should normally be requested through that provider’s procedure.

Where a legal right of withdrawal exists, the User may exercise it within the applicable period.

For digital services or content with immediate performance, the right of withdrawal may be lost when the User has expressly requested the start of the service, has acknowledged such loss, and the corresponding legal requirements have been met.

Nothing in this clause removes the User’s rights when the service is defective, non-conforming, or an incorrect charge has been made.

13. Third-party services

Aithor may use or integrate with external providers of:

  • Artificial intelligence.
  • Hosting and storage.
  • Authentication.
  • Payment processing.
  • Search and references.
  • Analytics and security.
  • Email.
  • App stores.

Aithor’s availability may depend in part on these providers.

Some features may also be subject to the corresponding provider’s terms.

When a purchase is managed by Apple, Google, or another third party, that provider may handle charging, billing, cancellation, and refunds.

Aithor may replace a provider or model with another when necessary to maintain, improve, or protect the service.

14. Service availability

Chatbot App Limited will take reasonable measures to keep Aithor available and secure.

However, it is not guaranteed that the Platform:

  • Will operate without interruption.
  • Will be free of errors or delays.
  • Will be compatible with all devices.
  • Will permanently maintain a specific provider, model, or feature.
  • Will allow recovery of deleted content.
  • Will always produce the expected results.

The service may be temporarily interrupted for maintenance, updates, technical failures, provider issues, security incidents, overload, or circumstances beyond Chatbot App Limited’s reasonable control.

Where possible, measures will be taken to reduce the impact and restore the service.

The User is responsible for keeping copies of important content and for exporting documents they do not want to lose.

15. Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including consumers’ mandatory rights.

To the extent permitted by law, Chatbot App Limited will not be liable for damages arising exclusively from:

  • Use of results without review or verification.
  • Decisions based solely on content generated by artificial intelligence.
  • The User’s breach of academic or professional rules.
  • Loss of content caused by a deletion requested by the User.
  • Problems with devices, networks, or external services.
  • Reasonable temporary interruptions.
  • Unauthorized access caused by the User’s breach of their security obligations.
  • Content or instructions provided by the User.

When the User acts as a business or professional, and to the extent legally permitted, Chatbot App Limited’s total liability for direct damages related to the service will be limited to the amount paid by the User to Aithor during the twelve months preceding the event giving rise to the claim.

This limitation will not apply in cases of fraud, willful misconduct, gross negligence, or other cases where liability cannot legally be limited.

16. Suspension and account closure

The User may stop using Aithor or request deletion of their account at any time.

Before deleting it, they must export the documents or content they wish to keep.

Chatbot App Limited may suspend or close an account when there is:

  • Serious or repeated breach of these Terms.
  • Fraud, abuse, or unlawful activity.
  • Non-payment.
  • Circumvention of limits or security measures.
  • Infringement of third-party rights.
  • Risk to the Platform or its users.
  • A legal obligation or authority request.

When closure is not attributable to the User and affects a pending paid period, Aithor will allow use of the contracted period, offer an equivalent alternative, or make the corresponding proportional refund.

Account deletion and subscription cancellation are different processes. The User must first cancel any active subscription, especially if it is managed by an external provider.

17. Privacy

The User’s personal data will be processed in accordance with the Aithor Privacy Policy.

When using certain features, the necessary prompts, documents, or files may be processed by external artificial intelligence or infrastructure providers.

The use of cookies and similar technologies is explained in the Aithor Cookie Policy.

18. Changes to these Terms

Chatbot App Limited may update these Terms for legal, technical, operational, commercial, or security reasons.

The current version will be published on Aithor and will indicate the update date.

Minor changes may be communicated by publishing them on the Platform.

When a change materially affects the User’s rights, an active subscription, or an essential paid feature, reasonable notice will be provided by email, within the Platform, or through another suitable means.

Where the law requires express acceptance, it will be requested before the new conditions are applied.

19. Governing law and dispute resolution

When the User is a consumer, they will retain the protection of the mandatory rules of the country in which they reside, where those rules apply.

Consumers may bring proceedings before the competent courts and authorities determined by applicable law, including the courts of their place of residence where appropriate.

When the User acts exclusively as a business or professional, these Terms will be governed by the laws of Hong Kong and disputes will be submitted to the competent courts of Hong Kong, unless a mandatory rule provides otherwise.

Before initiating legal proceedings, the parties will attempt in good faith to resolve the dispute through direct communication.

20. Final provisions

If any clause is declared invalid or unenforceable, the remainder of the Terms will continue in force.

Failure to immediately exercise a right does not constitute a waiver of the right to exercise it later.

The User may not transfer their account or the rights arising from these Terms without Chatbot App Limited’s authorization.

Chatbot App Limited may transfer the contract in the context of a reorganization, merger, acquisition, or business transfer, provided the User’s rights and applicable law are respected.
